USFS said no. It involves crossing private property as well as needing a patch work of USFS land to connect the dots.

Longer version of the opinion on KSL. Suit cannot be refilled, only option would be an appeal to the 10th Circuit Court of Appeals in Denver. Doubtful they would take an appeal of this type of case. Expense of continuing this case would go up exponentially.
