    mandatory indefinite quarantine for H1N1 Swine Flu. WTF?

    Whats next, pink eye? genital warts? Its the fucking flu, no more, no less. This is a violation of our constitutional rights and no one should stand for it. If I lived there and thought I had the swine flu, I would stay the fuck away from the doctor, and from the camps. But it goes even farther than quarantining the sick, to be able to send it to anyone who "may have had contact with someone with swine flu", ie: this is an excuse for the government to indefinitely jail anyone in their camps who they feel like. Whats to say they wont implement this in every state next?

    This is up for voting as we speak it appears for Iowa and other states have said they will adopt it if the virus turns 'deadlier' whatever the hell that means. You can go to the CDC website and search for it yourself.

    The Iowa Department of Public Health (Department) has determined that you have had contact with a person with Novel Influenza A H1N1. Novel Influenza A H1N1 is a disease which is spread from person to person and is associated fever (greater than 100.0 F), cough, sore throat, rhinorrhea (runny nose), nasal congestion, body aches, headache, chills and fatigue. Novel Influenza A H1N1 presents a risk of serious harm to public health and if it spreads in the community severe public health consequences may result.

    The Department has determined that it is necessary to quarantine your movement to a specific facility to prevent further spread of this disease. The Department has determined that quarantine in your home and other less restrictive alternatives are not acceptable because [insert the reason home quarantine is not acceptable, the person violated a previously issued home quarantine order, the person does not have an appropriate home setting conducive to home quarantine, etc.] The Department is therefore ordering you to comply with the following provisions during the entire period of quarantine:

    1. Terms of confinement. You are ordered to remain at the quarantine facility,
    _____________________ [insert name and address of facility], from ___________ to
    ____________ [insert dates of quarantine].

    2. Requirements during confinement. During the period of quarantine:

    a. You must not leave the quarantine facility at any time unless you have
    received prior written authorization from the Department to do so.

    b. You must not come into contact with anyone except the following persons:

    (i) other persons who are also under similar quarantine order at the
    quarantine facility;
    (ii) authorized healthcare providers and other staff at the quarantine
    facility;
    (iii) authorized Department staff or other persons acting on behalf of
    the Department; and
    (iv) such other persons as are authorized by the Department.

    c. Your daily needs, including food, shelter, and medical care, will be
    provided for you during the period of quarantine at the quarantine facility.
    You should bring clothing, toiletries, and other personal items with you to
    the quarantine facility. You will have limited access to a telephone at the quarantine facility. You may bring your cell phone with you should you
    desire to have greater access to a means of communication.

    d. You should inform your employer that you are under quarantine order and
    are not authorized to physically come to the work place, although you may
    work from the facility via electronic or other means if appropriate. You
    should be aware that Iowa law prohibits an employer from firing,
    demoting, or otherwise discriminating against an employee due to the
    compliance of an employee with a quarantine order issued by the
    Department. (Iowa Code section 139A.13A).

    3. Information about Novel Influenza A H1N1. You should review the information contained at Attachment A for information about Novel Influenza A H1N1. You should refer to information provided at the quarantine facility to address specific concerns and questions you have about Novel Influenza A H1N1. In order to find out more information about Novel Influenza A H1N1 and its symptoms and spread, you may also access the Department’s web- page at www.idph.state.ia.us. If you do not have access to the internet from the quarantine facility, you may contact the Department at 1-800-362-2736.

    4. Legal authority. This order is issued pursuant to the legal authority contained at Iowa Code chapters 135, 139A and 641 Iowa Administrative Code chapter 1, a copy of which is labeled Attachment B and is attached to this order for your review. The Department shall comply with the principles for quarantine contained in subrule 1.9(3) of this attachment when issuing and implementing this order.

    5. Ensuring compliance. In order to ensure that you strictly comply with this Quarantine Order the Department or persons authorized by the Department may regularly inspect the quarantine facility.

    6. Violations of order. If you fail to comply with this Quarantine Order you may be ordered to be quarantined in a more restrictive facility. In addition, failure to comply with this order is a simple misdemeanor for which you may be arrested, fined, and imprisoned.

    7. Your rights B appeal rights. While under quarantine you have the rights as described in subrule 1.9(8) of Attachment B. In addition, you have the right to appeal this order pursuant to subrule 1.9(7) of Attachment B.

    This appears to be a matter of Iowa state law. What does the CDC have to do with this?

    What constitutional rights would be violated by issuance of such a notice if, indeed, there were an epidemic? The states have broad police powers in the event of an epidemic.

    I do believe the government can legally quarantine people, they certainly have in the past. If the H1N1 virus does a 1918 type pandemic quarantine will be the least of our worries.

    The potential for this virus to kill millions is there. I am not saying it will; it probably won't but the potential is there. I lost two uncles to the 1918 pandemic (I obviously never knew them), and my dad survived it because it didn't affect babies very seriously. One of these days we are going to have another major pandemic of a really virulent virus, and as much as I hate to admit it, big government like the CDC and WHO are going to be really necessary to keep it semi under control.

    I agree it is a constitutional right for Americans to be assholes...its just too bad that so many take the opportunity...

    Where does it say indefinite quarantine? What I saw was a form notification for quarantine with the beginning and end dates left blank, so they could be filled in by the department of health. The dates need to be left blank as they will be different dates for each patient. The fact that there is a space for end date means that it is NOT indefinite, as the end date defines the length of the quarantine. Duh.

    Geeze talk about rampant paranoia.

    hutash, you are correct. There is no doubt that the states' police power permits quarantining in an epidemic. This is merely a template, a precaution by the Iowa DOH if things get bad. And they could get bad in a hurry.

    If they already have not done so, the whacky right wingnut Fox News fucks will no doubt jump on this as evil big government. Those miserable fucks.

    the crazy thing about this strain from what i hear is that it actually hits healthy people the hardest since tits the immune response that gets you not the actual flu. my bosses' husband had it fierce and she had to get tested. normally i am pretty meh about these "killer flu" strains but this one seems to have some legs to it

    I'm old enough to have possibly developed antibodies when the H1N1 strain was around in the late 1950's. You youngsters are at higher risk than we old goats.

    Two-thirds of my mid-20s friends (including me) came back from San Diego over the 4th with Influenza A. Nobody was tested for H1N1 (two of my friends tested positive for Flu A but didn't get the H1N1 work done), but I have a strong suspicion (based on the symptoms, season, etc.) that it was H1N1. I felt pretty shitty for about four days, and then just had some congestion for a couple of weeks. GF was hit for 5-7 days, and had the same congestion. She's a first grade teacher and is very rarely sick--especially in the summer.

    Bottom line: As it stands, for most people, it seems just like the normal flu (this statement is not just from my personal experience).

    Thankfully, it hasn't gotten more virulent (knock on wood) in the last few months. The CDC forecast numbers are still pretty damn ugly, but I'm pretty sure most of the healthy folks that frequent TGR should be fine.

    Not "you have been tested and you are infected" -- just "we say you've been exposed, and we do not need ANY PROOF of this nor any reason other than our own say-so to incarcerate you."

    You're being softened up to accept arbitrary incursions of unconstitutional authority in every facet of your life. Unconstitutional searches and asset seizures in the name of the "War On Drugs", pervasive unconstitutional surveillance and arbitrary denial of the right of free travel in the name of the "War On Terror", and now unconstitutional "quarantine orders" (i.e. incarceration) that don't require any sickness or anything beyond a random government official's say-so -- all designed to get you used to the leash.

    another problem with this:

    If you are being quarantined with other people who have H1N1/ have just had contact with someone who has H1N1, how can you ever be let out if they are continuously having more contact with other people who have H1N1? Obviously at some point flu season will end but thats a long fucking time to be jailed against your will

    no one ever said its happened yet, thats not the point, the point is there is legislation on the table pushing for it right now, and they are preparing for it to happen.
