    The law doesn't really care about how expensive the fence would be, and with enough signs you don't need a fence. Also, FWIW, this particular broheim wasn't in his yard or driveway. Most roads are public and if you're on a road between a bunch of houses it's fairly reasonable to assume you can travel through. Brighton may not be able to maintain a ropeline there, but they could put up some signage at the gate indicating how/if you can get back to SR190 without trespassing.

    This whole thing is just weird. Surely this has been happening for decades, and now the guy decides to go scorched Earth?
    I'm surprised there are so many excuses given to the trespasser, I say fuck him and the landowner IMO. it's very easy to figure out when skiing through a neighborhood it's private property. Guy was going to his air bnb, he wasn't lost and missed the Millie exit.

    Can anyone who rides/exits that zone at the bottom of Hidden verify if there are no trespassing signs around those properties and how visible they are?

    Maybe this guy has been nicely trying to deal with this trespassing issue for years and has finally had enough...would actually like to hear his story....

    Gun owner should be thanking the snowboarder tho for posting that viral video....aint nobody going to ride through there anymore

    Typically, you can't assault people for a dishonest purposeful trespass either. Especially if they just snowboard down the last part of your driveway.

    like I said in a previous post... if you are made aware from the property owner that you are trespassing on their property AND YOU CONTINUE TO TRAVEL THROUGH IT...they have every right to use reasonable force to prevent you from doing so....that includes standing in front of you, blocking you, pushing you to get off their property, turning you around back where you came from. yelling at you etc.....If you as the trespasser continue to ignore the property owners demands then prepare to deal with the consequences.

    Even if there were no signs the snowboarder was verbally made aware he was trespassing, he should've immediately turned around back where he came from....but instead he continued to walk through the private property hence the confrontation and a bit of shoving from the land owner.

    Also think the skiers and snowboarder are idiots, I mean I see someone with a gun pointed at me im stopping and turning around going back where I came from....cant believe they continued to ride past/approach the dude and laughing about it after. jeesh

    ^^^Pretty sure the owner of the property does not own the neighborhood road. His driveway is where the vehicles are parked.
    The trespass actually occurred before he dropped down the bank to the road

    I keep watching the video to try to see what you're describing. In the video I saw, the snowboarder apologizes and then does immediately turn around. The shoving from the landowner came out of nowhere and I don't see any attempt by the boarder to ignore the guys warnings.

    I mean he should've fully turned around and went back in the direction he came from....snowboarder then proceeded to walk past the land owner down the private drive and laugh about it with the skiers after which seemed a bit disrespectful.

    Anyways... Im assuming this landowner is in the right to claim trespassing....but, If the drive/road is in fact public the snowboarder could file an assault charge.

    I don't think you understand there is nothing but private property behind him. He came through private property to drop onto a neighborhood road. It's not his private drive and SR 190 was straight ahead

    Dude seemed pretty confident that its his private property, I mean he's out there in a chair with a shotgun. and the private road sign on tree. Just goin by what i'm seein.... and who knows what those 2 skiers said did as they passed by him....could've set the dude off and the snowboarder caught the flak.

    I have no idea who he is or if he owns that road/drive and if he has the right to claim trespassing but it sure seems like he does. ....if its like you say think he could be in trouble or face assault charges tho. ???

    There's a lot of cabins off that road. His driveway is where you see the white Ford. The road definitely cuts through lots, but then again, so does SR190. The road may very well be owned by a co-op of owners, I don't know. But it's certainly not his road to enforce trespass by gunpoint.
    Snowboarder obviously rented a place that the HO advertised ski in/out tho. So maybe he rented from someone within that co-op.
    Town of Brighton may very well assess taxes and clear the neighborhood roads as well.

    But the road is a private drive in which a private road is a road over which a limited number of people have the right to pass and is different then a public neighborhood roads that share property lines. I guess who owns it and who gets to enforce trespassing rules on it?... based on Yukonriders property lines map it seems dude w shotgun (CR) does.

    Well, with as much access/egress and actual skiing that occurs on private property in the Wasatch daily, seems like a valid discussion. Certainly nothing for the stoke police to shut down

    I really don’t think this is true. Tried to look though Utah code and the only things I could find allowing for any use of force or providing an affirmative defense to assault required aggression from the trespasser or some kind of fear for one’s safety.

    Neither of those exist here. An apologetic snowboarder taking the shortest and most obvious path off the property (And not being told otherwise) does not deserve assault.

    Can we stop pretending getting patted on the chest like that such a big deal? Pressing charges for that is wasting everyone's time. IMO the property owner was just seeing if the trespasser was muscular enough to be his new gimp. He decided he wasn't and let him go.
