unfortunately that may not be the case-many schools have a "student code of conduct" that covers about anything under the sun. the school I work at can bring a student in front of a judiciary board (the student can't be represented by a lawyer or anyone at the hearing) whatever decision they make is final and can't be appealed.

Walk over to the Dean of Students office, calmy and humbly explain your situation and your concern. Start telling it to the receptionist, take the earliest appt you can no matter what the time and be there early.
I've always had good luck with the DoS offices of a few different schools in terms of student advocacy in retarded Kafka-esque academic bullshit situations.

Tell him how you learned a lot through all the punishment you've already gone through.

Find out which of your teachers works as a student advocate and schedule a meeting. They will give you the best advice and help you push your case through.

FYI. You are facing school sanctions not government sanctions. Most schools will not let you bring anyone into the hearing that is not affiliated with the school. The only use you have for a lawyer is to bring a lawsuit against CU.

Context is important for comprehension. Cliff, had you read the context following the post I quoted, maybe it would register as sarcasm.

In a mid-level Chem course a paper discussing man-made global warming was assigned. I wrote a paper which disagreed with the professor's stance, and debunked alot of the "facts" he'd one-sidedly presented in class. It easily fell within the guidelines of the assignment, even the TAs agreed with me, and he flunked me because I disagreed with his bullshit assertions and had scientific backing for my disagreement.

I filed a formal complaint, threatened legal action, and the grade was removed from my records, and I promptly left the school, because I'll be damned if I'm going pay out of state tuition to get slapped around.

And yeah, the sentiment is normal in alot of universities, but there aren't alot of professors with the gall to flunk someone for disagreeing on the basis of fact.

Serious note here. You need to manage to keep this off your college records. Question I have is is this an "administrative" function of the school, or are these separate criminal offenses imposed by the school.

One thought I have is to assert double jeopardy. Can't be tried for the same crime twice.

I don't know how judicial sanctions work at your school. I assume, that like at many schools, they can go after you for stuff done off campus.

At most schools the campus judicial system does not function like the state legal system*. You may not get a lawyer or advocate, the judge may be the same person as the jury, and the overall tone of the thing may be less "innocent until proven guilty" and more "tell us what happened and we'll tell you your punishment."

In campus judicial systems you are often expected to cooperate with the tribunal/whatever; therefore silence = maximum penalty (remember, no "innocent until proven guilty"). Because of this feature campus judicial systems may wait until after the state judicial process has run its course - if the campus went after you before or at the same time as the state you could be in a bind. You'd want to stay silent (or present limited information in your favor) before the state, but spill the beans and plead for leniency from the school. If your campus trial occurred first the state may be able to take your statements at the campus hearing and use them against you later on.

This is a round-about way of saying, that your school may have a reason for going after you only after the state has had its way with you.

Whatever the case, the school may know that you're square with the law; but they may still want a swing at you. It would be best to figure out what they want and what your options are. Then pick the best one and follow-through. It may be that you're getting fucked, but the unfairness of that doesn't change the fact that you're still getting fucked and that you will have to deal with the fucking in one way or another.

similar situation happened to me. basically the school makes up their own rules. best thing to do is to talk the dean/student services/student advisors to get their perspective, or even the school paper to make them and others aware of the situations. and show, in official paperwork, what you have already done for the state.
