    Hmm, I didn’t know about that second part. I thought that’s what the bail bondsman is paid the 10% for, and why they hire bounty hunters to track down miscreants when they skip bail. Otherwise, why would they have any motivation to do that, if the accused has to have some collateral to cover the full bail amount?

    But you are a lawyer (at least that’s the impression I had) so you probably know this much better than me.

    Also, I think some of you are confusing the difference between bail and bond.
    Bail is essentially collateral so you don't run away while you're awaiting/on trial. Since you haven't been convicted of a crime, and if the State can't or won't convince a judge of probable cause to hold you without bail, you can leave if you loan them money.
    A bond is money you GIVE to a bail bondsman. Typically 10%. They put up the collateral and you don't get the money back. They can also hunt you down if you skip town.
    When they say $50,000 bond, doesn't that mean bail was half a mill?
    I'm not saying this shit isn't ridiculous, just laying out a civics lesson.

    I doubt we'll learn the real circumstances of his arrest since from him, since that would be stupid for him or his family to post that.

    AFAICT, the bail was set at $50K, thus the need to raise $5K for a bond premium.

    The bail bonding company supplies a bond in the amount of the bail. The bond -- a promise to pay the full bail amount upon non-appearance -- is underwritten by a court-approved bonding company. The bondsman takes a cut and the balance of the premium gets paid to the underwriter. If the subject does not appear at court, the underwriter pays (forfeits) the bail amount (in this case $50K) and a warrant is issued for the arrest of the subject (now a bail skipper). Then the underwriter seeks a remedy. If the underwriter tracks down the subject and makes him eventually appear, the court may pay back some or all of the forfeited bail to the underwriter, but not always, i.e., sometimes the entire bond is forfeited. Under the indemnification agreement, the underwriter can collect whatever bail is paid (and not returned) plus the costs of hunting down the bail skipper, court costs, interests, attorneys fees and other expenses. Thus, sometimes the security and/or guaranty is tapped for more than the full bond amount.

    OK, that all sounds right. I still don’t see where there’s a requirement for the accused to have assets to pledge to cover the entire bail amount fits in that scenario, though. There are plenty of indigents who would never be able to get out on bail if that were the case. But I won’t cunt up this thread further. I’m done.

    There is no legal requirement. It's a contractual requirement of the bond underwriter. Most underwriters will not issue a bond in a significant amount without some form of security to go after in the event it forfeits bail. Absent security, the underwriter might take multiple personal guaranties from family members (after doing a credit check and checking employment, assets, etc.). I know of one case where 4 family members signed personal guaranties as a condition to getting a bond issued. Luckily for them, their crack addict daughter/sibling showed up for her hearing date.

    Per this reality, indigent people without generous friends for families very often cannot secure a bond and remain in jail until the hearing. On any given day, there are thousands of people in county jails who couldn't make bail (i.e., could not post a bail bond).

    When a family pledges security and guaranties to back up the indemnification, and their family member fails to appear, the family is screwed.

    We are reminded that the marijuana was originally outlawed by the feds as a weapon against minorities. (Back then, marijuana was considered a "black drug.") The feds doubled down in the 1960s and 1970s when it became a hippie drug.

    Marijuana legalization IS big government. Most Idahoans I've encountered deem themselves to be "anti-big government" yet I cannot imagine the ID electorate would ever support legalization. Fucking hypocrites

    gang- LBL’s daughter asked to not share on Facebook given the conservative nature of their community. i just went to chk in on the gofundme and noticed a couple FB shares. while i guess we probably use his username here it may get tracked back to his daughter’s name so could you guys pls delete any FB posts?

    also good call on the needing to get this done asap with the holiday weekend. if not I say we band together and go break him out. this is a travesty
