    Legal Advice...

    I have posted a couple of times in the past about a friend of mine who was handed the shit end of the stick by his wife over Christmas. She has a boyfriend, wants a dovorce, leaving him and the kids, blah blah blah. It turns out that for the past 10 or 11 years she has been mis-appropriating funds, and out right stealing money from her work. She obviously does not have a job anymore, and is being investigated by the police. From what the detective is telling my friend, charges are pending, and a convition is likely. (my friend did not know this was going on, and is not being investigated)

    I assume that if she is convicted she is going to have to pay restitution, and the only asset she has to her name is equity in the house. Is there anyway for my friend to protect his half of the marital assets throughout this whole process? Is he screwed because he was married to this crack whore? He is in the process of divorcing her, but it will not be finalized for some time.

    I appreciate the help...

    He should go for that divorce.
    Until a divorce is finalized and belongings completely separated and recognized as this by the state, what is his is hers also.
    Got to love marriage.

    The answer to your question, which addresses both marital property and the responsibilities of one spouse for the tortious and criminal acts of the other, will depend on what state or country he resides, as the applicable laws will vary greatly by jurisdiction.

    In other words, it ain't so simple.

    He's got a lawyer. He is in Montana if that helps...

    Then the lawyer, who knows Montana law, and who is getting paid, will know how to deal with it. Your friend needs to ask direct questions on how he can maximize protection on assets in light of the theft. If the lawyer can't tell him, he needs a new lawyer.

    Word. Why is stuff like this hard to understand for some people?
