    Lawyer help needed

    I was just talking to a co-worker who is wondering what if there is anything she can do. Heres the scoop.

    About 8 months ago she got engaged to a guy. This guy has shit for credit, was $13,000 upside down in his current car and wanted a new car so he convinces her to let him buy the new car on her credit and roll the negative $ on to the new loan. (Stupid ass action on her part I know and now she does too.) So two months later they call the wedding off and part ways his way happened to be driving the new car. They agreed that he could have the car as long as he made the payments on time. Now 6 months later she is trying to buy a house and with that car on her credit she is having difficulty getting a loan for the home she wants. She wants to sell the car to pay off the loan and make him pay her the $13,000 extra put on the loan because obviously they can't recoup all there $ by just selling the car. He basically told her to go eat a dick and that he would give her $8,000 and the car.

    So her question is this:

    Is he completely bent over a barrel with her pants down because the loan is in her name, or is there any action she can take agains this dick?

    I think she's screwed...she can definitely get the car but I don't know any special tricks or reasons why she isn't stuck with the whole loan. Too bad they didn't get married...then, depending on the state, he might be stuck for half of it.

    But it sounds like, if this guy is as much of a scheister as you say, $8k and the car is not bad - she should cut her losses and call it a lesson learned.

    Bummer for your friend.

    Problem, she willingly inhertited the $13,000 of his previous debt. If she takes the keys, she's still holding the bag.

    Take the $8,000 and the keys, or wait on buying a house until he can pay his way out. Lesson learned: never trust ANYONE with your credit. She will save over $5,000 on the home loan by fixing her credit problems
    I've concluded that DJSapp was never DJSapp, and Not DJSapp is also not DJSapp, so that means he's telling the truth now and he was lying before.

    If she's on the loan...whether or not he buys the car, she'll still have the debt. If its worth more than 8000, then she should take the car and sell the fucker.

    +1 for calling him out. Pretty much the only option she has right now.

    Make sure she's ready to take posession of the car immediately and has some backup muscle when she makes her demand in person. If she gives an asshole like that an inch of wiggle room after that type of ultimatum, he'll fuck that car up.

    Surely there are better ways of getting nuts deeps with your co-workers beyond sorting their credit problems? This is a longwinded route to the bedroom for sure, and you run the risk of becoming "just good friends."

    Getting back to the point...I think she's stuffed.

    Very bad advice. There are remedies in civil court to recover the car. Report it stolen when it is not and she will get charged with filing a false police report.

    Her best option is take the $8k (weasle more if she can) and the car and chalk this up to an expensive lesson about putting her name on someone else's credit. She will spend more on attorneys wrangling with the mess than she stands to gain.

    Agreed.

    Take the $8K. Have the guy sign a promissory note to pay the rest, if she can get him to do this.

    +1 Take the car and whatever cash she can get up front. Have him sign a promissory note for the rest. Then sell the note to a collection agency for pennies on the dollar. She gets a little cash and he gets the strong arm. Good lesson for both of them.

    Believe me if you saw this girl you would know that sticking it to her is the last thing on my mind. The girl looks like Humpty Dumpty, one big oval from head to butt and no shape anywhere in between.

    She pretty much knows she's screwed. I just figured maybe someone here was as stupid as she was and found a way out.

    Hang on, I think there's some confusion here. This is the scenario as I see it:

    -Girl offers to take out loan out for a new car + his $13,000 debt on old car.
    -Girl gets car title and loan in her name
    -Guy promises to pay girl monthly payments on the loan (car + 13,000)
    -Girl wants to ditch the loan to improve credit score (breach of aggrement)
    -Guy doesn't want to take posession of the loan + title, or pay loan in full (13,000 + car)
    -Guy makes counter-offer to give girl $8,000 + car (which is already hers) to compensate. Girl can then sell car to recoup more of the loan.

    Options so far recomended:
    1. Take/steal the car (Pretty stupid, It's legaly hers and this leaves her with 13,000 debt + depreciation loss on car to pay)

    2. Do nothing, have him continue making monthly payments (doesn't get her a house or immediately improve credit score)

    3. Take his offer of the car + $8,000, then sell car (expensive lesson learned to NEVER put anyone in control of your credit)

    3a. Take his offer and try to get him to sign a promisary note: best option to fully recover cash and get relief on credit
