    UPS damaged frame. WWMD?

    I bought a Cannondale x-bike from a guy in NC. It arrived with a dent in the top tube. We went through the claim process and I got a new frame out of the deal. I switche dthe parts over. I was supposed to send the dented frame back to NC so I took it to UPS. They wanted $72 to ship it. I said that seemed unreasonable as they dented the original frame in the first place. They said I was being unreasonable because I got a new frame out of the deal. I told them to f off and if they wanted the frame back they would have to come get it at my house and left my address. The original seller emailed for the serial number and that was the last correspondence I've had with anyone regarding the whole thing and that was four months ago. I'm guessing he reported the s/n to Cannondale so no one can warranty this frame. I'm totally cool with this and wasn't thinking about a warranty anyway.

    My question is this: did UPS just write this off so I scored a free dented frame for my trouble? I don't want to call them to remind them about it to find out. The frame is totally rideable-I rode it for a month before the new frame came. The local frame expert at the shop I go to said he didn't see any stuctural anything that would worry him about riding it. I'm thinking of switching the parts back and selling the new frame and just riding the dented one or building the dented one up. I don't want to do anything with it and then have a UPS guy show up so anyone have experience something similar to this?

    and $72.00 to ship a frame back..Fack. I shipped a frame + rear wheel to denmark for $35.00 a few months ago with the usps.
    Since then it's been a book you read in reverse, so you understand less as the pages turn.

    You might want to see what the legal minds on the board have to say; but, I think (emphasis added) after ninety days it's considered abandonment*. If I'm correct, the frame is yours to do with as you see fit.


    * Or some such legal nonsense.

    Similar incident with Fed Ex. I shipped an emaculate S-Works 120 to Colorado in Dec 05.The bike showed up with 2 dents in the dt, even though it was professionally packeged. The bike was insured for 5000.00. I used an independent Fed Ex shipper, so they and the receiver had to deal with. It took about 2 1/2 months of wrangling.They finally issued a check for close to 3000.00 for frame replacement, but never mentioned anything about reclaiming the frame/bike. The guy still has the complete rideable (dented) bike and a big fat check! He has'nt had riding opportunities yet, but plans on using it soon.

    It's the shop's problem, not yours. It's their bike, and if they want it, they can send a call tag for it. THEY [the consignee] had a contract [shipping document] with UPS, and it is up to either one of them to reclaim it if they want it. All you did was receive a damaged frame. If they don't make an effort to get it back, tuff. Sell/trade it away at will.

    They didn't report the s/n to Cdale for warranty purposes. It wasn't a warranty issue, so Cannondale could'nt care less.

    Having worked in a bike shop for 10+ years, and also 3 or so yrs. part-time in a UPS shipping hub, my $.02 is that the guy who sold it to you knew he could potentially make a buck out of it by talking you into giving it back & reselling as damaged, and wanted you to foot the bill.

    Not to mention it has never cost me any more than $30 MAX to ship a frame from coast to coast via FedEx ground. .....I don't ship w/ UPS.
