    How to Deal with eBay assholes?

    Won a bike auction on eBay July 22. Two weeks, five emails and one phone call later seller-dick has not delivered and refused on the phone to say when he might "get around to it." I know i can go into the dispute resolution shit, but I think that is more likely to just make him take more time to piss me off. I know the guy's name, where he works, phone number so I'm not worried about ultimately being scammed, I am worried about not having the damn bike to ride NOW. While I daydream about exacting painful revenge by power sanding his grundel or maybe making him spend an afternoon with Blurred there doesn't seem to a whole lot i can do.

    So, question is, anyone else have any other suggestions? I was thinking about using this nifty service, anyone tried it?:

    PayPaL? If so, make an inquiry with PP, they will contact him and finger it out. If not, I would just fuck him and get my money back.

    yes, both very practical answers, but missing both the substance of the post and the intent of the question. I want the bike and to be a dick inthe same manner as he has done to me. leaving negative feedback and whining to paypal will not lead to accomplishing either.

    However, has anyone ever used paypal buyer complaint feature? How long does it take?

    I had a guy never send an ebay item. no response for a couple of weeks then out of the blue he emails saying items shipped. I only bought one item. I went on to the paypal complaint deal, got an automated response with a number that day. The next day got another email from paypal saying the deal was resolved and my account credited. Worked pretty damn fast. I didn't miss the substance of your post. I could tell you wanted the bike. I guess I may have erred in thinking that you may want to get your money back in lieu of nothing.

    What absolutely kills me is that this mofo is part owner of a bike shop...so you know it would be nothing for him to have one of his shop monkeys take 10 minutes to pack this thing up and get it in the mail. If this continues to go south I'll be sure to engage in an active message board campaign aimed at the Tennesse road and mtn bike community, letting them know what a douche they have in their midst. Went ahead and started Paypal wheels in motion in the meantime.

    If he does a lot of business on e-Bay, then threatening him with Negative Feedback is the best. Paypal WILL give you your money back (they did for me) and people like myself DO care about feedback before bidding. If someone wrote "Never sent item after getting payment" potential buyers will avoid him like the plague, which could seriously damage this dude's livelihood.

    If it's some College kid schmuck selling his spare crap before going back to school then you're fucked. get yer money back and learn how to play the system.

    I agree with you that the threat of negative feedback is supposed to keep the system in line, I certainly looked at his feedback and it was 99.4% with "fast, speedy, great etc. all over leading me to bid and expect smooth sailing. But, given the fact that this guy knows i am unhappy and has gone out of his way to be a dick even when talking in person on the phone, he's got to expect negative feedback and doesn't seem to care. So, I am playing the system but this is an instance where it don't work.

    well, time to put your money where your mouth is..
    Have you threatened negative feedback & reporting the fraud to EBAY?
    if not, give him one last chance with deadlines to receive bike to make good. then follow through with NEG Feedback for sure.

    if he is a big seller, he shouldn't want to fuck around with that.

    I know someone in the fraud dept @ ebay that could pretty quickly shut him down in this scenario. even if you just reported it through normal fraud channels, it would severely impact him.

    I just won a new board in Ebay this past weekend....The guy said he sent it out monday, 2 day mail..(I live 20 miles from himacross LA)..not here yet..He was also pissed that he used the automated shipping charges which were $11, but said he ended up paying $60...he didn't excatly ask for more money, but I got a weird vibe..

    getting stressed and pissed..

    I had a problem with a seller and thought about going the dispute route with eBay but thought better of it. eBay has to try and please two people in a dispute(seller/buyer) and not you alone. I ultimately decided to get my refund through my credit card company. The credit card industry is very competitive and they will try and please you as a customer. Good luck...

    The biggest problem with negative feedback, is many sellers wait till they've received feedback before they leave feedback for you. If you leave negative, they leave negative. Kind of a chickenshit way to do business, but that's the way it goes I guess.

    Update. This guy sucks my balls. After two more emails and talking to him on the phone a second time, he made some lame excuses and said it would be in the mail yesterday or today and he would send confirmation. That of course did not happen. I just went ahead with the negative feedback even though it is not likely to help. At this point the whole reason i wanted a new bike -- trip this coming weekend -- is shot to shit and I will have to borrow or rent, so much longer ain't gonna hurt. Given that I know so much about him, I'm not worried about not getting my $$ back if it comes to that...maybe I should be.

    My direct quote feedback, damn that 80 character limit, it makes you be creative with spelling and punctuation: "dishonest,slow, horrible communication.18 dys since pay = no deliv. & no explan."

    Funny that it's for a Santa Cruz Heckler.
    Maybe you should post his name and the shops phone number. Then we can call the shop, ask for him directly so he has to stop what he is doing, and ask if he knows anything about or has a Heckler for sale.
    After about 100 phone calls and two days of wasted work he may just give you the bike to stop the insanity.

    I would pursue getting your money back and getting out of the deal as quickly as possible. Be it through paypal your card company or ebay or all three. They all have dispute resolutions and they all have time limits on how long they'll stay interested. The longer you wait the less options you'll have. Being a dick back may bring satisfaction on some level (I'm not sure which) but getting the money back will be end it quicker and of course butthead then has to hunt for another buyer which is probably the best way to put the screws to him.
    It's not so much the model year, it's the high mileage or meterage to keep the youth of Canada happy
