    Lawyer mags, help needed for restraining order hearing (Not4Me)

    As bizarre as this tale sounds, it is true. My friend's boss (lets call her Jane) is of an alternative lifestyle (please save the jokes, its not hot by any means). Here is the basic story. Her ex-partner of 8 years (lets call her bitch), from which they have been separated for 3 now, was a very abusive one. Jane had 2 kids before changing her ways, which makes things tough for those involved.

    Now for the last 3 years, the Bitch has done the following:
    Keyed her car 3times, threw a rock through her rear window of her car last week(no proof)
    Drives by Jane's house and her new partner's house all the time
    Leaves threatening voicemails (proof here)
    Has thrashed her new partner's office at work (long story, no proof)
    Made threatening phone calls to new partner
    While they were together she abused Jane and her kids (physically and mentally) and went as far as getting a therapist letter saying it was ok to hit Jane's kids (this I am sure is a fake)
    Bitch went as far a going to court to try and get custody of Jane's kids (of which she lost in a hurry)
    No doubt it has fucked with all involved. Bitch is a very evil, vindictive, mentally troubled pain in the ass.

    Now bitch runs a shady business, of which we know she hires cheap labor and never pays them, they just quit. She has never registered her car, does not pay appropriate taxes. Unfortunately Jane's new partner works under the same Corporation as bitch, but does not want to be "outed" in fear of possibly loosing her job or being discriminated against.

    This is just the tip of the iceberg as far as crazy things this woman has done. I have offered to help with "alternative" solutions; from which I was told "no" it would probably just escalate things.

    Bitch is getting served on Tuesday with a subpoena by the police to appear in court for the restraining order. Jane has talked to a lawyer friend, I do not believe she needs an attorney for the hearing. Bitch has had this coming for a long time and Jane is very un-nerved by the whole matter.

    I am looking for the best items that would do the most damage so Jane's restraining order is successful. I have already told Jane, any solid proof that she has will be her best bet. Unfortunatly, Bitch is a very cunning one, and has done a lot of these evil deeds behind the scenes, not leaving much of a trace. Anyone with some insight or maybe personal experience with restraining orders, it would be greatly appreciated. Jane is a great person and needs the help.

    Sounds like an awful situation and my best wishes go to Jane for a peaceful resolution. Nobody needs or deserves that kind of harassment. Let us know if there's anything we can do.

    Seriously though, don't get yourself into trouble. If Jane has documentation of the things that bitch has done, that's the best bet in court. Now that I've done the disclaimer of not getting yourself into trouble, any way you can recruit some folks (ie: law enforcement) to help catch her in the act of doing something? It sounds like she's a nut case.

    so far i think the police are being good because there are kids involved. Since she is such a sneaky bitch, i don't doubt that she won't try to contact/violate the restraining order. It will be just a matter of trying to catch her in the act of doing it.

    Super sketchy situation for your friend. As longas the police are being proactive to catch this chick in violation, that will help for something.
    The scariest part is that for truly messed up people with a vendetta, a piece of paper telling them what they can and can't do offers very little disincentive. However, in most states it is a criminal offense that matches the severity (felony/misdemeanor) of any crime they may commit if that is how they violate.

    My Bro's ex-girlfriend ended up doing some time in the slam (10 days and then 30 days) for doing much the same kind of shit to him. She was snaky, vindictive and and very bad news. She actually went to far as to inflict bruises on her face somehow, drive to my bro's place and call the cops on her cell saying he beat her up. My bro was asleep when the popo rolled up and an hour later he was in jail on a domestic assault charge.

    What saved his ass was getting friendly with the cops (this is a relatively small town) and convincing them she was nuts. Once they believed him they paid attention and caught her in the act in a couple of things. After the second jail stint she went away, let's hope she stays away.

    Are the kids Jane's alone? If there are children between the two partners that might make things stickier. This being the Hate State, I don't know that the courts would recognize any visitation rights for a non-relative former partner from a sinful "alternative lifestyle" [/sarcasm and little tolerance for intolerance] anyway.

    Having worked in a Family Court and having seen a lot of TROs and PPOs, I would say that if your friend is genuinely concerned for her safety and is credible-seeming an attorney isn't entirely necessary. People go pro se in these domestic settings all the time... Lots of times custodial parents will try to get PPOs etc. against the noncustodial parent just to fuck with them and keep them from seeing their kids. But if Jane really has no motives other than to safeguard her family's health and well-being, she should be okay. Again, this is based entirely on my experience, and I haven't looked up the Code or anything, but when you put someone in a courtroom it's usually pretty obvious who's credible and who isn't. If it's apparent that Jane isn't being vindictive or blowing things out of proportion, she should be fine with just her testimony.

    Never a bad idea to talk to a real lawyer, though.

    This isn't the area of law I work in (not by a long shot), but I would say that the more evidence she can bring to the hearing, the better. It doesn't have to be documentary evidence -- other people could come with to testify if they have firsthand knowledge of the things that "bitch" has done; even the children can testify.

    There may be free legal services to help her out. (This varies by locality as to whether there are free legal aid clinics, or just lists of lawyers willing to help out in their areas of specialty.) Have her call the local bar association (county bar association usually) and ask for a referral if there is "pro bono" assistance available.

    Why would you think she doesn't need a lawyer. You said she's tweaked by this...wouldn't it be better to have the more rational professional provide the judge with the facts as opposed to the emotional victim?????? especially when she should expect the bitch to show up and deny everything. The last thing your friend wants to have happen is for the hearing to disentagrate into a screaming match w/ psycho bitch.

    Trust me, she should take her lawyer.
