    not sure how much scotus has to do with it. while scotus in graham vs connor and tennessee vs garner established that an officer's use of force is judged by the standard of objective reasonableness. It's up to the trial jury to decide if the officer's behavior was reasonable--whether it was reasonable for him to fear for his life or for the safety of the community when using deadly force. In too many cases juries are deciding that obviously unreasonable fear is reasonable. It appears that the blackness of a subject is considered an adequate reason for an officer to fear for his life. Most jurors fear crime and black people more than they fear the police--until it is they or their loved one that is killed or injured by the police.

    I received my law degree from GSL--Google School of Law--like the rest of us.

    I think if I have a reasonable fear that I might be shot by an leo then I should be able to murder him, I mean eliminate the threat, by shooting first. Sound reasonable?

    to make a very long story short--two different cases, officers killed during no knock searches by people who didn't know the intruders were police. And here's a surprise--grand juries did not indict the white guy, did indict the black guy who is awaiting trial for murder.

    Yes he reached... and the police created the fucking situation. You have a terrified drunk guy who you have threatened to kill repeatedly and are shouting complex physical instructions at... anything short of perfect compliance is death... that is on the police.

    My reference was to the scotus case that essentially made the exculpatory standard for police response to be "perceived threat". All the subsequent training and court cases have devolved from there, not that it was great prior to that.

    The perception of threat has to be reasonable, per the supreme court. It is still up to the jury to decide what is reasonable. I think a lot of the cases that go to trial are overcharged--murder when a more appropriate charge might be involuntary manslaughter or the like. In most cases the officer is poorly trained, inherently fearful of black people, and unable to cope with a stressful situation. There are of course cases where murder is the appropriate charge--where the officer by his words or actions shows that he intended to kill an unarmed person. When the charge is too high juries are more likely to acquit in borderline cases. This is criminal law 101 at Google School of Law.
    What would help a lot of these situations would be for officers to be trained to be calm. You're a lot less likely to make a wrong but innocent move if the officer is not screaming at you and threatening to blow your fucking head off. I don't know why police think that screaming at someone is the best way to get them to comply. Something I've scene a lot in ER's with belligerent, generally drunk or mentally ill patients--officer screaming at the patient who is getting more and more agitated and confontational, then nurse--who might be a large man--comes in a calmly gets control of the patient and the situation.

    So in the Mesa, AZ murder I asked myself why the cops respond to a 911 callers claims like an order and not something to investigate first?

    Well in Kansas, some poor bastard answering his front door was shot dead by swat after some asshole in California called in a false hostage situation over an online gaming dispute. They didn’t even shoot the right gamer either.

    If you don’t like someone just call swat, they’ll take care of him. Amazing idiots.
