Aspen Inmate Argues He's Really In Republic Of Texas
Man Says Colorado Laws Don't Apply To Him

ASPEN, Colo. -- Sure, the town is 8,000 feet above sea level and the snow is nearly 2 feet deep, but a Pitkin County Jail inmate is arguing he should go free because he's in the Republic of Texas.
Timothy Paul Kootenay told a district judge on Monday that Colorado has no right to hold him because a small sliver of the state, including Aspen, is part of the original Republic of Texas -- which he argues still exists as a sovereign nation.
The judge wasn't convinced. He ordered Kootenay held on $50,000 bail on a California warrant alleging he violated parole for a check fraud conviction.
Kootenay, 43, is part of a band of believers who argue the U.S. annexation of Texas in 1845 was illegal and that old republic's former territory isn't subject to U.S. or state laws.
Kootenay is fighting extradition to California. If he loses, he said, he'll appeal -- to the International Court of Justice at The Hague.
