    Legal advice needed: D.U.I. (NSR)

    Fuck. Fuck fuck fuck. Yesterday, comming out of the LCC, two cops followed me from GMD and flashed me when dropping a friend off at the P&R at the mouth. Fuck. A field test and two breathalyzers later I walk out the Cottonwood station with a D.U.I. Fuck me. I blew a .08, but because I am 20 and this is Utah ("not a drop" policy) they nailed me. I guess I should lawyer up asap, or something. I don't know. Please some advice guys.

    Drinking and driving is about as stupid as you can get, but hopefully you know that now.

    Bottom line, we've all done things that were pretty damn stupid. I don't think the kid is asking if anyone thinks he did a smart thing.

    Lawyer up, do everything he tells you. Pay him, pay fines, perform all court actions, move on.

    First of all, don't be too hard on yourself. You fucked up, but as a prosecutor who works in misdemeanors I see more than my fair share of DUIs. The type of person who gets them runs the gammet from functioning alcoholic to the generally law abiding human being who had a momentary lapse of judgement. That said, get yourself an attorney. There are plenty of people who you can retain on a sliding scale base on what you can afford. There are even attorneys who you can retain for just a few hours to get an assessment of your case, if they wouldn't just do it for free. DO WHAT EVER PREVENTIVE MEASURES THAT YOU CAN TO BE IN TOTAL COMPLIANCE AND SHOW TO THE COURT THAT YOU ARE AWARE AND SORRY FOR WHAT YOU HAVE DONE. If the court order is going to require an alcohol dependancy evaluation, have that sucker completed and the write up in your hand before your first pretrial conference so that you can show to the judge that you are taking this seriously. I know that in negotiating cases, this type of gesture is taken into consideration and can be the difference between a straight plea with jail time and a deferred sentence with the chance of the case being dismissed within 2 years.     no need to get jackie childs, but let them deal with it

    I seriously doubt you'll walk scot free, especially since you're not 21, but the plea bargain can make it a lot easier

    and along with what girlski said...see if there's some kind of volunteer work or perhaps an alcohol class you can take BEFORE your trial, to show that you know you messed up.

    People get duis, it happens, but you can definatley soften the blow

    That sucks!This is in no way a condoning of anything!

    That BAC represents about 2 beers in an hour.It's a proven fact that people talking on cell phones are at LEAST as impaired as someone blowing .08.

    Old people in Florida don't have to take a drivers test,a vision test or anything else to renew their license due to the political power of the AARP.

    I'm not happy about ,& whole heartedly disagree with a lot of things that are made into laws.Voice your opinion freely,just spare us the sactimonius diatribe.

    It sucks running on wrecks where drunk people who thought they were sober have maimed an innocent mother and her children but the drunk is A-OK.

    What's fucking stupid is when assholes like you pretend to stand on some moral high ground because you've never been caught.

    .08 is no worse than driving angry or sleepy, it's just bullshit law put through by mourning mothers who think that putting people like PacRimRider in prison is going to bring back their lost children.     BTW, if you've ever driven in Taos, half the drivers you shared the road with were legally drunk. I probably covered 25% of my miles down there legally drunk...and somehow I drove just fine. I also seemed to find quite a few sober drivers in the ditch in Taos Canyon. Somehow everything gets along just fine in Northern New Mexico, even though nearly everyone drives around smoking a joint with a Corona between their legs.

    It would be a nicer (if perhaps shorter) life if people would have some balls, some faith, and actually support freedom once in a while.

    As others have said.. lawyer up. It is worth the money. After court fees and fines, you should do a little better than if you had taken it on by yourself. Obviously you have now experienced that flash of genius that several of us have already (reluctantly) seen, and won't be repeating this again (if not, ain't a thing that any of us can help you with). Understand that every month for the next couple years you will be writing a car insurance check that will be a constant reminder of your DUI.

    We all screw up at some point in life. Be glad that you didn't screw anyone else up along the way.

    I hafta disagree with you on this one. Many socially liberal countries, like Scandinavian countries, are currently going to .02. Why? Is Sweden run by Nazis? In Norway, I believe, you are fined two months income and a mandatory 15 days in jail for DUI. Two months income. That really hurts the rich bastards out there. The US has some of the most lax DUI laws in the civilized world.

    So, .08 is no big deal, eh? I'm not going to throw rocks at a glass house, but I've learned my lesson. Arriving at a hospital in time to barely recognize my sister before she almost died being airlifted to another hospital was one lesson. Visiting her while she was in traction for several months was lesson two. Losing close friends from school and work were more lessons. Another was getting a bunch of wannabe lawyers hammered with my old crim law professor until all were noticeably drunk and then hauling them down to the PD to blow on the Intoxilizer 3000 - only one of the three blew over the limit. Trust me, I would never want the other two driving me around!!!

    I, for one, hope PacRimRider gets off easy with a lesson learned. Hopefully a seasoned prosecutor and Judge who believe in discretion will choose to exercise some in his case. Regardless, the lesson is don't drink and drive. I don't do it. Ever. Last time I was a bit hammered happened to be in Seattle with Girlski, Squirrel99 and Z-bo a couple weeks ago. I had a ride plan (Z-Bo's totally pimp and mint 70's Caddy playa-mobile) and I slept on Squirrel's couch (I'm a veteran on that thing). Anyway, if you don't want to take it seriously, it's up to you. However, I pity any facker that wrecks into my friends or family with a BAC over the legal limit. I will do my best to crush you.

    PRR, get a good lawyer. Follow Girlski's (young padowan) advice -- there are several rehab groups, etc... you can join. Actually take it seriously -- there's no reason not to.

    Whether you get a lawyer or not, you're going to pay the same amount of money for this when it's all said and done. But a lawyer will help you in many ways, and may even save you a little bit. Don't fuck around. Get a good attorney ASAP (early next week, don't wait).
