Okay -- I would have several questions.

Extent of the assault victims injuries??? Superficial? Broken bones? CT Scans showing epidural or subdural hematomas, serious edema, or other conditions associated with a closed head injury??? The documented nature and extent of the injuries WILL be a determining factor in sentencing.

The official statements provided to the police by all relevant parties. I can guarantee that those official statements are different than the statements they may provide to each other or to their friends.

Where did the bat come from? Location and timing can show premeditation vs. heat of passion.

Were any parties tested for Meth or any other drugs?

What was BAC of the parties?

Were any drugs confiscated from anyone's person?

When was the rape allegation made? Was a rape kit done? Based on the implied lack of consent of a knock-out victim, a rape kit is prolly worthless anyway, but still should be done.

Was a condom used (can be indicative of consent)?

Was there any previous history of intercourse?

Any prior convictions for assault, drugs, B &E, or false statements/obstruction?

What statements where provided by third party witnesses at the bar about the actions of all relevant parties?

I could honestly go on forever, but I gotta actually go to work tomorrow. There is no way to adequately determine a true theory without all the facts and right now, we have very few facts.

It is possible she is lying. Sheeeit pregnant chicks are the horniest chicks on the planet. She has two drinks and her boyfreind ditches her for his habits. I know a few girls that might do the same.

And they will identify you as the culprit. And unless it was videotaped or some other mofo's were in the room, it's your word against hers. It is an unstoppable defense to be sure. My all time favorite. Yep, I think he's going to be getting introduced to large men named Bubba in the not so distant future. Still a bummer for me. My lord. Just talked to the guy to try to beat some sense into his rotted little brain, and he's just gone. Doesn't want to defend himself. "I'm too scared. I can't afford a lawyer. I can't deal. Blah, blah, blah" Now he's just loading up the car and driving south of the border. "If I ignore it hard enough, it will just disappear." I tried to give him a little support and that's more than I should have done I guess. He deserves whatever he gets. Stupid MoFo. Just sucks to see a friend of 20 years reduced to this. NO, which is probably a good thing. South of the border will NOT be a good place for him. The bad stuff is cheaper and more plentiful down there. Her family blames the entire incident on him and has her pretty much locked up under private 'house arrest'. Can't really blame them.

Out there is right. I've barely talked to this guy over the last year just to distance myself from him. Gimme a break though, we learned how to ski powder together and were thick as theives once. Tough to just completely slam the door in his face. I had to at least listen to him since he has NEVER done anything to me or anyone else I know. Was never aggressive, never stole from me/anyone else or anything like that.

Cutting the cord sometimes helps though, makes people wake the fuck up and see they're screwing themselves and everyone around them.

Or if it dosen't, then they're really screwed.
