    Angry Legal Maggots and the evilness that is Meth

    A question for a friend who is in a whole heap o' trouble. Here's the skinny. A couple goes to a ski town to stay with a single guy 'friend'. All 3 go to bar, and all is hunky dory. The boyfriend leaves the bar to go do I don't know what(most likely score/sell meth). He returns to bar to find girlfriend and friend/host gone. Goes back to host's house and finds door locked which is highly, highly unusual. Breaks in to find said 'friend' and girlfriend in bed together. Boyfriend proceeds to beat crap out of former friend with baseball bat. Girlfriend's story is that the guy slipped her a roofie (date rape drug) took her back to his place and raped her. She had two drinks(she's no lightweight) and barely remembers a thing. No doubt that my friend did the beating. I'm wondering if the alleged rape and the circumstances around it would be a mitigating factor in the case. The cops won't even listen to her side of the story. Facing B&E, assault with deadly weapon, etc. This is an old friend, rippin' skier, who got hooked on meth about 18 months ago and has been in a steady death spiral ever since. My old friend is great, but all I've seen the last 18 months is his evil meth addict twin. He has given up skiing, biking, surfing, travelling and everything else for this evil F*cking drug!!!! He had to have been spun as a Mofo to be capable of this. I'm just in disbelief and hoping he doesn't go to the 'State Pound me in the ass prison" for the next 10 years. He's never been in trouble before this. Anyone got a direction I can point him in? Any suggestions are much appreciated. There's only one kind of powder that anyone needs to be messing with and we all know where it lurks.

    Maybe the girlfriend can "remember" that she was screaming for help which the boyfriend heard, which is why he broke into a locked house that wasn't his.

    Where did he get the bat? did he bring it or find it there?

    If this is your friend's first offense, he might get lucky and if the state where he is prosecuted has a drug court option in lieu of prison, then he might get to do his time in treatment. Otherwise...your buddy managed to rack up some serious charges in a short amount of time. I am inclined to think that maybe sometime in prison isn't such a bad idea to clean him up and straighten him out...IMHO

    Maybe yes, maybe no. I'm believing her for now. She's pretty smitten with him and is carrying his child just to make it an even more f-ed up situation.

    I agree that SOME time in the pokey wouldn't necessarily be bad for him.

    Just for fun. These things DO happen for real. Probably more often than we realize. What would your stance be IF she is telling the truth. Stranger things have happened.

    Rehab would probably be better for him. Getting drugs in jail isn't that big of a problem, or so I hear....

    Nice edit. Good thing you added the part about the meth head, breaking in, and the pregnant girl. It was ridiculous before, that really made it believable.

    I have to say that I have a hard time feeling sorry for your friend LIP. He is a perfect example of the trickle down affect of being a drug addict. Like I said, if he is lucky he will get referred to drug court (Sorry I didn't explain more Char- it is probation requiring strict compliance with in patient drug treatment in lieu of substantial jail time) or some sort of reduced sentence, get his life back on track and be a decent father. That pregnancy is such a nice twist, as if the situation weren't bad enough.

    It's cool, I just know for a fact that sending a drug addict to jail doesn't solve shit. They either are using in jail or start immediatly after they get out. If they don't get into rehab they are fucked, and very often they are fucked even with rehab.

    I don't understand what his meth use has to do with this situation, at least as far as the police are concerned. When they came to the house, did they catch him with some? Or was he visibly intoxicated?

    IMO, if you come home and Jeebus is in bed with your old lady, you are well within your rights to beat him within an inch of his life.

    if i were johnny cochrane and your buddy's defense lawyer, i say that the girlfriend was drugged and kidnapped and raped and the police shit the bed by not using a rape kit and giving her a blood test right after the incident, making it impossible to view your buddy's actions in the correct factual framework. if she was actually drugged and he was actually in the process of raping her when your buddy walked in, he might have a chance at justifying beating him with a bat. if it was after the fact and they were passed out or whatever, there is no justification for the violence. ideally the violence would be towards him and he could get self defense, but a jury might be sensitive to him seeing his pregnant, drugged, kidnapped girlfriend being raped. that said, if they know he was cranked up on meth, i would guess he has no shot.

    but i don't know shit and its your state laws that matter. but you would have to provide more details as to what the cops know, etc. to get any solid guesses.

    It does not make sense. If Chewbacca does not make sense, you must acquit!
