    what about the fat employees? or employees with a family history of health problems? better get rid of them as well.

    The difference is that smoking is a conscious decision. Family health history and in most cases, obesity is not.

    Heh, I watch 5 hours of TV everyday and haven't had fresh veggies unless someone snuck them in my Ramen noodles.

    If health insurance agencies charge people different rates based on their health, why shouldn't employers?

    The problem we would have with allowing insurers to charge different rates based on health history, etc., is that they would also get to charge different rates based on your participation in "risky activities".

    Like skiing, mountain biking, kayaking, motorcycling, etc. All of which you have total control over your participation or lack thereof.

    Of course, the curve is different. Activities are riskier for the young, bad health is riskier for the old. I'm also guessing that end-of-life care costs a lot more than ACL reconstructions. But my point is that a completely free market might screw us along with the couch potatoes.

    Smokers are the only group left that society has no problem discriminating against.

    I'm sure if you spent a few minutes thinking about that, you'd be able to find a few others. I did.

    Hard to feel sorry for someone who makes the conscious choice to become a smoker, doesn't have any intention of quitting, and then pisses and moans about discrimination.
