    I got BEEF

    Beef with people who think court is the answer to all problems.

    I'll be polite cause you never know in what circles this might end up in.

    But fuck really who does that shit... take ya to court over a pair of skis for fuck sake.

    Fine so I don't know how to use ebay and I'm a total morron to not have read all the terms and conditions.
    First time worked perfect for the big daddys they went to a good home at a fair price. That really got me stoked.

    Now them other skis, I just can't sell em at the price the last bidder put in and I explained nicely and honestly the situation. I paid tree times that for the ski and was hoping to get a few more bucks out of the auction ( reserve price from now on believe me you ). I don't want to sell em at that rediculus price... I rather keep em. And I could get more in a month or two when the snow flies. The lack of understanding here just pisses me off. Can't humans get along specially skiers.

    This dude decides to threaten to take me to court for the value of the skis and legal expenses...

    Whatever happened to lets just all get along... fine I made a mistake but fuck it's just a pair of skis and a few bucks. Chill out on all that court shit.

    There I feel better now but I would have a few more violent words but I'll bottle till I get an other reply from monsieur in question. I needed to vent tabarnak


    I'm not looking for a lecture on the use of ebay I on top of it believe me I'll read the whole contract starting now....

    Until you accept payment (cash the check or recieve a paypal payment) it's not a legal transaction. Best he could do is sue you for breach of contract (ebay contract), but the penalty involved should be much less than if money had actually transfered hands without the goods being exchanged.

    What a shithead. My advice is to tell him to go get fucked.

    Not to be a voice of dissent, but I'd be pretty fucking pissed if I bid on something, and then the person decided not to sell them to me. Otherwise, what's the point of bidding at all? Its a waste of my time, and that time is money. It sucks that you fucked up your transaction, and it sucks that the guy is pursuing you. But if I bid on something, that means I want something, and there is an understanding on eBay that if an item is up for bid, it is for sale. I dunno man, but I can't really feel sorry for you...

    I agree with Bakerboy. There definetly ways to protect yourself from getting into that situation. It definetly sucks but I guess its a lesson learned.

    Yup I know. must get reading glasses for the fine print. But that ain't the point. I admit the error and eat the lemon and the oignon and the cat food.

    Note to self fine print sucks but you gotta read it. Fuck that shit is long to read, where is the abreviated version or the instructional video with the naked ladies.

    Rules suck when you can't use em to your advantage. What ? can you say hypocrite...

    I hate to say it, but if you didn't even bother to learn enough about ebay to know to put a reserve price on stuff you were selling, it is hard to feel sorry for you. If you'd been browsing ebay for 10 minutes you would have noticed something with a "reserve price not met" hyperlink that explains it if you didn't get the concept.

    Regardless of Ebay's fine print, and the reserve price, don't you understand how an auction works? The (edit) highest bidder wins - this is the most basic principle of an auction. You're saying you didn't know this? Bullshit!

    When you defaut on the deal, everyone suffers. Auctions function on trust - if we all thought that we might not win an auction if the seller thinks the deal was too sweet for you, no one would use the auctions.

    How would you feel if you were in HIS place? Would you believe (or even care) that the seller "didn't understand" the fundamental principle of an auction (the lowest bidder wins)?

    Be a man, sack up. and do the responsible thing. Send him the skis and learn a lesson. If you don't, then you lose your honor and integrity, and that a lot more than a few bucks.

    I hope he takes you to court and wins.

    Little boys make mistakes and then complain about "what's fair". Be a man and take responsibility for your mistake.

    D'oh! Idiot. I meant highest bidder of course.

    Actually, I don't think this should go to court. It won't, because there's not enough money involved, etc. But I still think he should just admit he screwed up and give the guy the skis. Yes, it sucks, but it's the right thing to do.

    Fine print? What fine print? You didn't understand going in that the highest bidder wins? Yes, you just thought you'd get more for the skis. That's eBay. Some things you sell go for much more than you expected, so go for much less.

    Give the buyer his skis and move on.

    This kinda reminds me of people who blame the ski area when they run into lift towers, snow making equipment, etc. Quit yer fucking whining and sell the skis to the guy and apologize for your actions. What did you expect us to give you sympathy for screwing up on something as simple as selling on Ebay? Why didn't you do your homework before you listed the item? You could have gotten info from Ebay or posted here then. Once you screwed up you gotta sell.

    Gorrilo, you need to live up to your part of the contract and ship the dude his sticks.
    Failure to set a reserve price or minimum bid amount is your fault, not the bidders.

    Chalk it up as a lesson learned, and apologize to the buyer for the hassle you've given him so far. (Thats the only way you're going to prevent bad feedback which would brand you as untrustworthy)

    The only reason the bidder is talking court is because you are jerking him around on his winning bid. You would lose.


    A harsh lesson, but it's an error you won't make again.

    But damn do we have to be so agro about everything. Suck to loose cash on a stupid little error.

    Man I got in on this late, damn. I've used eBay a lot, bought and sold. It IS all about trust and that's the cool thing about it.

    YOU made a mistake and you freely admit it but you don't want to take your lumps because it will cost you money. Then you bitch that this guy would threaten court over mere money. All your logic is based on what is best for you and changes when it doesn't work that way. That is to say you're not using logic at all merely self centered greed. Then you come here looking to vent and get support.

    Are you saying if somebody had bid way more than you expected you would have told them it was too much and compromised to a lower price? Come on you only get it one way and the contract states it clearly as does the whole premise of an auction.

    You could have done the reserve and you also could have set a starting price with no reserve. That's not fine print that's like the first friggin' paragraph of how to list.

    The maggot community is supporting you. It's supporting you to grow up and take responsibility for your mistakes and not make others take the hit for you.
