Sign on tree in video says Private rd as he is walking past....this took place on the residents drive/property which turns off of Old Prospect ave. Not sure if that drive is really considered private or public tho...looks like a few other houses back there on that same "private road"...Seems a bit excessive to be sitting out there with a shotgun, but who knows what people are going through, be careful out there.

I would hope that Brighton resort and this guy could do more to make people aware to stay off his property....good thing hes not sitting up in Cardiff fork haha.
I have thought of coming out of the BC around there, looked at a map to see where I'd come out on the highway, and saw I'd have to go through someone's yard, so I never did. Everyone who goes through there is lying if they say they didn't know it's private IMO, signs or not, unless they drove around beforehand to see where it is possible - maybe it is possible somewhere, I don't know. I bet dozens of dumb bros go through his yard on a good day, and it's not the owners fault that happens. Fuck around, find out. I strongly don't believe in using guns for intimidation but fuck that Loren guy and the internet mob he created to out the owner (I'm not defending the owner pulling a gun). Everyone involved all deserve each other and their drama, ha.
And how tall would the fence have to be to not get buried every winter and high enough to stop people coming through? 15-20 feet high? Sounds real cheap.

most people think that a) it's his fault for living next to a ski resort, b) you should be allowed to ride wherever you want regardless of private or public property.

I'll also say I don't think sitting in your chair with a gun is also the appropriate way to enforce your private property rights!

Ski Patrol needs to setup/maintain a temporary rope line during the winter ski season along those property lines....seems like the most reasonable easiest solution??? If you duck the rope and are caught prepare to get blasted or issued a trespassing ticket....FAFO?
UAC prelim report says 4 caught and carried, damn, that one could have been a lot worse. Firewater is no joke, for such a small bump that NE facing shot is properly scary.
The Brighton story, sheesh... Add that to the list of zones you're likely to get shot for crossing invisible boundaries.
I'm expecting to get annihilated here too. I've trespassed before, I'm no saint, but if I trespassed and was met with a crazy person with a gun, I'd think something like "Well, that guy is crazy but I know better to trespass anywhere in gun-loving America so that was a really dumb idea".
That's not apples to apples - but yes, of course I would. It would suck but what would my argument be against it? I'm a spoiled BC user who doesn't like to be told what to do? My toys got taken away that I never owned but got to use for free, and now I'm mad?
Guessing here - I don't think they can because it's not part of their permit, but you make a good point. The owners of all the properties could do this and then add 'NRA Member' signs or whatevs to intimidate. But I think that owner likes to spend afternoons roughing up the Ikoners, ha.

As stated above, it's on the property owner to properly mark their property boundary if they don't want trespassers. IME that property boundary nor the resort boundary isn't very well marked in that area and its easy to ski down there and miss the traverse back to the Millicent lift. I also don't think pointing a gun at someone for trespassing is an appropriate response.
In other news, the skiing was pretty good out there this morning. I did have to correct someone as he was telling some passersby that it was dust on crust, while you can easily find the crust out there, it was much more than dust on top of it.
At first I thought I empathized with both the home owner and the boarder, but upon reflection it's the opposite, I think both parties can go suck a turd. Douche ignoring people's property and other douche escalating it 100x by swinging out a f*&$^ shotgun, they can have each other
yeah not exactly sure how it works but I think in this case there needs to be some exceptions made.... Brighton Resort, Forest Service, Landowners, Law enforcement need to work something out. Temporary rope line that the resort maintains with obvious signage seems most logical. It would probably be easier for ski patrol to maintain it with landowners approval even though technically its not their responsibility? Would be a nice gesture to keep the peace and de-escalate the situation.
I dont agree with that guys tactics but he has every right to do so....getting/calling the police involved and have them issue criminal trespass tickets (lame but...) would be safer and more effective IMO. Trying to detain someone while the police show up could get ugly, ...video surveillance could be another deterrent ?
Exact same situation up in Cardiff, how many of us ignore the signage and blast through the orange fences....only difference is theres nobody enforcing it
There have been some posts from UAC about people skinning up Emmas from Bay City and Landowners wanting people to stop skinning up their driveway and right next to their house.

If I'm accurate here, if the private property is not properly posted and signed, and is not in current agricultural use then persons may travel through without permission, but if asked to leave things change.
Its not on brighton for the ropeline, but could help, its definitely on the landowner to have proper legal signage requirements up.
Regardless, dude is out of line albiet well within his rights (minus getting hands on).
I highly doubt random snowboarder tourist actually knows whether he was on private property or not.
Sounds like he was following tracks back towards his airbnb that was probably sold as "ski in/ski out". You can't assault people for an honest mistake...
When it comes to trespassing using reasonable force is different then assault. The snowboarder was made aware immediately that he was trespassing... Gun owner could have physically stopped him from continuing to cross his property and turned him around to where he came from....
It gets tricky cause originally the snowboarder posed no imminent harm but once made aware they are trespassing and they continue to travel through your property pushing and shoving someone to stop someone from entering your property once made aware they are trespassing is not assault and is reasonable force.
Im guessing if he ended up shooting someone for skiing down his drive exiting from the resort that would be deemed excessive force and might go to jail for that....but lets say the situation made a turn for the worse...say snowboarder dude started getting hostile and pushed the gunowner or attacked him now snowboarder is an immediate threat and Gun owner has every right to shoot him.
Very scary situation and not something to be taken lightly....be careful out there, trespassing is no joke and can go bad very quickly.
That sign is pretty irrelevant for anyone entering from the east. A quick search of the county assessor site didn't reveal anything either way about an easement, but it definitely could exist.
The law doesn't really care about how expensive the fence would be, and with enough signs you don't need a fence. Also, FWIW, this particular broheim wasn't in his yard or driveway. Most roads are public and if you're on a road between a bunch of houses it's fairly reasonable to assume you can travel through. Brighton may not be able to maintain a ropeline there, but they could put up some signage at the gate indicating how/if you can get back to SR190 without trespassing.
This whole thing is just weird. Surely this has been happening for decades, and now the guy decides to go scorched Earth?
The property owner handled it like a dick. His property should have proper signage if he is this concerned. It’s also a users responsibility to know where they are and to respect private property. A lot of states put the onus on the user and not the owner.
