Any chance of penalty for a frivolous lawsuit here? I look forward to giving the SOC a read...I'm assuming it's all about libel? I imagine one of the key sites is 'SSV Watch' - while it's definitely not written as an opinion, it doesn't attempt to state absolute facts either, but rather poses questions (with obvious intent)...which wouldn't seem like libel to me.

Is anyone aware of any other cases of this nature in our new media era? Surely similar smear campaigns (as with this one, they are probably justified) have come up against various companies with poor service/HR reputations (ie. Walmart)...have any of the targeted companies gone on the attack like this in the court system? Or is this more unprecedented jackassery from the Scurfields?

well sure they are - everyone knows this. But WTF... these guys don't seem to be doing many smart things to protect themselves. They, of anyone, should know exactly how the scurfields are when it comes to legal actions.

I don't dispute existing jackassery from them...I am curious if there are any recent examples of an organization doing further damage to a social media storm by launching additional lawsuits? I imagine there are and I'm curious how they played out, but this has a special caddyshack/Ski School feel to it!

My layman's understanding is that the burden of proof will be on SSV to prove that factual statements made on these sites are untrue...is that right? Sounds like a pretty tall task to me...there's an awful lot of he said/she said, and I can't think of anything that came out of this that could be proven as an outright lie...Will we ever see any of the specific statements that they may be referring too?

Who else was just about ready to move on? I was actually thinking about skiing at Sunshine this season, now I'm having second thoughts.

Forgive my law JONGness as I only took 1 law course in Uni. Is Sunshine going to sue the Herald and CBC for posting an article that reminds the public about this fiasco?

Didn't sunshinevillagewatch only ever really post to bring to light Sunshine's environmental and safety issues? As if Parks really cared anyways...

Significantly lower ticket sales? let's see some numbers... Doesn't have anything to do with Norquay's $99 midweek, KHMR opening up more terrain, and Charlie just being a total BOSS at Lake Louise...

Well there was a TGR thread that was a bit more explicit than this one, and TGR received a cease and desist order from the Scumshine/Scumfield lawyers.

TGR420 then told us that he had to remove the thread, because the Scurfields have more money than brains.

federal or provincial wouldn't matter, it all goes to harper. next time i see him strolling past the playground with his entourage (his parents must live in the same neighbourhood) i'll be sure to mention it as a concerned citizen ;)

i hear something about an extended 'avalanche zone' limiting parking along the road to SSV (AB rockies thread). knowing that people willingly turn back when they have to park at km 8 away from the ski hill, i wonder if DasCunt's superpowers aren't at work already!

If SSV wants to get into a pissing contest about "spreading lies", how about we all file a class action over their lies most days on their snow report... If you really want to talk about lying, those are some of the biggest lies I've ever seen. Either that or somebody on their staff really doesn't understand where to place decimal points...

Is SSV still claiming all natural snow? ie. no snowmaking.

So how does a "John Doe" get served anyway? Will the judgement from any trial be binding, or can a default judgement be issued if a J Doe does not file a response?

I'll also agree with everyone who can't understand the logic of starting this back up. They basically went and found the biggest hornets nest just before it was about to die off for the winter, for good, and then pissed on it.

This has to be a vendetta by the owners. I just can't imagine it's a settlement leverage attempt since a goal of any settlement would have been (or should have been) to brush the whole thing under the rug. This looks like people with lots of money for lawyers trying to crush people who have very little money to pay for lawyers.

I wonder how much longer until this thread gets deleted as well...

I tried to keep a critical eye in the first thread (where I thought there was a 2nd side to the story that SSV wasn't at liberty to discuss) but everything they've done since has wash away any doubt I've ever had. What everyone is saying about the Scurfields having more cash than brains has proven true -- for example even if they succeed at crushing these people, they've still ultimately lost in the court of public opinion.

I see the pond scum has risen back to the top and it's not due to seasonal turnover. It may be due to douchebaggery?

I'd just like to add that I have not skied at SSV since all of this initially happened (I did ski there a a few times a year previously), and I don't plan to drop a dime there so long as they own it. My decision has nothing to do with this supposed boycott campaign, but rather their idiotic handling of the whole affair in social media. Sunshine has only itself to blame for losing my business.

A junior family member related to a ski hill just outside Banff may or may not have a social media account that rhymes with glitter. Read through some of the tweets and you'll get a good sense of what a douchenozzle you're dealing with. Hope that daddy's proud!

Wonder how much this has cost these guys in legal fees so far. I mean a 12 page claim from Field isn't THAT expensive, but altogether this could get pricey, particularly if there's no settlement. I imagine this lawsuit is actually a pretty half-hearted attempt to apply pressure to settle. Given that Chevalier has a senior and experienced lawyer from Norton Rose on for him it seems certain that he'll be well advised on what's going on here.

My friend grew up with these types and this kind of thing is pretty much common and common knowledge so when I heard about the whole SSV debacle I wasn't really suprised

They made their fortune in real estate not oil.

Most people growing up in the new suburbs of Calgary in the 70s lived in a NuWest house or community.

Billion dollar company at one point, then crashed during the early 80s when the last housing bubble burst.

My folks lived on the same street as the Scurfield family (Ralph Snr), who had a monstrous house completely out of character for the neighbourhood.

Couple things - this is not legal advice but opinion -as I understand it:

- You don't get sued for "organizing a boycott" you get sued for defamation.
- that the words complained of were true is a defence to defamation.
- SLAPP lawsuits are frowned upon and can result in painful cost awards:

-That being said - making anonymous public statements about the other party to a lawsuit you are involved in does not sound like a very good idea. Especially where there seems to be a number of folks willing to make the same statements.
