Indeed, the malicious mischief statutes are being enforced in California to keep certain 'undesirable' skiers out of certain resorts. I have come quite close to making the list due to certain articles I written that have been critical of certain resort managements.Quote:

California's Malicious Mischief statute states:
Every person who willfully commits a trespass by any of the following acts is guilty of a misdemeanor:

This statute could be used to fine any one skiing in an avalanche area as well as skiing in an area of a ski resort where the resort does not want you to be. The resort as a lessee of the land has the right to control access to any part of the leased area, just like you have the right to control access to your own home or business. Here again, however, in order to be arrested, the area or trail must have signs posted indicating a closure.
What I'm saying is that certain resorts are restricting the rights of certain skiers from entering their lease area for reasons other than skiing OB. Happened last year because someone was demo'ing skis without permission, accused of selling said skis in competition with a certain resort's shop, banned and threatened with trespassing if they came back to that certain resort.

I agree with MJ. Lease provisions that are part of a Forest Service plan can exclude the public from those areas or allow a third party to control public access. All this is done through long periods of planning, public comment, etc... They can easily say they are not banning a specific individual, rather a class of individuals -- those who fail to adhere to safety and other restrictions imposed by the management. Restrcited access to logging areas, mining operations, etc, may be a useful analogy. Don't have time to page through USCAs, CFRs, or DOI opinions, but I'm sure there is precedent out there somewhere.Quote:

At the last Tahoe Summit I managed to get a huge ass red X put on my pass within ten seconds - a personal record. I set off down an entirely empty face below the Siberia Lift, only to be collared on the run out by some screaming dick who claimed I almost ended his promising Nazi-ing career by skiing into him. I missed him by a matter of inches. About 800 inches. :rolleyes:

i had a red jacket crash into me at squaw during the summit period of time last year. the guy looked kind of out of control, and turned right into me as we were moving towards the lift corral. he hit me hard enough that i went over the handlebars and down under the rope that cordons off the area where the lift exits the loading area.
within two minutes there were at least six red jackets swarming. they kept asking me if i was alright, offering to help me with my things and being generally apologetic. they kind of seemed like they realized that their buddy was an idiot and i could have been a huge jerk about the situation. instead, i was embarassed and tried to get out of there asap. maybe i should have made the stink with management that could have been possible, but i figure that there's a make/take relationship with respect and such in the universe. hopefully next time one of those red jacket dudes runs into a difficult situation he'll be more understanding... doubtful, but possible nonetheless.
