Like I said before, demand in the complaint is fairly irrelevant. Claim's worth $50-75k, IMO--based on the facts we have. POWDR should take an offer in that range and run. Once you start taking depositions, serving motions, etc. shit gets way more expensive than that. Fast.
Nah, not at all. I totally feel for them and it certainly sucks given the information provided. Totally sucks. I just have a hard time thinking this situation is worthy of that kind compensation/damages. Easy to sit back and armchair, but here we are. Too bad the mountain didn't make it right straight away. If I was the family, I'd forget the cash and ask for lifetime family passes to all Powdr resorts (not sure which ones they own). Would be no harm to the corp and a big benefit to a family of skiers. Win/Win

throwing in a big number for punitive damages is a scare tactic--since punitive damages aren't covered by insurance. This will settle for a lot less then 129K IMO as a TV trained lawyer (and as someone who's been sued).
Bachelor failed Risk Management 101 on this. Obviously management at the resort should have handled better at the time, and failing that corporate should have been all over the family trying to make it right. They had the opportunity to make the family feel better about Mt Bachelor than they did before the incident and blew it.
And there is the problem. Remember when they forgot to pay the rent @ PCMR. Just another fail for Powdr Corp. management.

I remember it every single day I ski at what was a friendly resort and now is a pay to park, pay 3x as much for a piece of pizza, watch out for the yellow jackets resort. Wish the dumb bitch hadn’t left the bill in the stack on her desk for three weeks. Wish we still had the failings of Powder over Vail.

Screaming at me for being a line skipping douche etc…ski patrol and the lifty escorted him out of line and asked for his jacket to the applause of the assembled locals.
