If you take option 1 you now have a car with an odometer reading lower than the title. If you try to sell the car you're going to be accused of setting back the odometer. If you total the car your insurance is going to accuse you of setting back the odometer. If the bank finds out about they're going to accuse you of setting back the odometer. At this point the number on the title is going to be the mileage on the car until you put another 88K+ miles on it. Take number 2. And make sure you notify the state that you are no longer the owner of the car. And good luck to the dealer selling that car. Expensive mistake.

This was a bit tongue in cheek but don’t treat their options as their final options / offers. Those are their initial offers. IF you believe them that this car really only has <65k miles and you can get it for less than a car with >155k miles then it is a steal. A certified letter from them would clear up any issues with the insurance and others I’d think.
Also, if you consider offer 1, then a clause stating that if the dealership breaks this agreement and you have to sue to enforce it they owe your attorney fees (but not vise versa) should be added.

I can't sell a Certified Pre Owned Lexus, because I am not a franchise Lexus dealer.
If you want a CPO vehicle with a manufacturer warranty, then you have to go to that franchise dealership.

Again, this is a well regarded dealership in our area with a franchise of the manufacturer that we bought. The vehicle was always serviced at a dealership and the odometer mileage reported by various dealerships always appears appropriate on the Carfax. The only discrepancy was the extra 90k reported by the DMV when the p/o moved to the current state. P/o or DMV employee mistake. The GM is aware of the financial liability hanging over his head. Hanlon's Razor and all that.
I agree in a perfect word, taking our money and moving on would be best. I have four weeks before I move my pregnant wife across the country and a working vehicle is part of the plan.
