Seed patents have been around since 1930 and are are held by individuals, private business, corps, universities (OSU makes $2.5 million off a wheat patent alone)... Many seeds are patented and in public domain. All patents expire..
Crazy thing is that some plants (mostly in nursery) are trademarked and these never expire. I'm thinking this is where weed will go.
[devils advocate] Without patents or trademarks plant breeders have no incentive to put any type of investment into improvement. This severely limits progress.

Just had a chance to read more on this potential patent and trademark issue-> until it becomes legal on the federal level it will be illegal to trademark and patent strains
