Distance requirements? I've never heard of that and you often see whales approaching boats, or even rubbing up against them. I've only gone with Sanctuary Cruises out of Moss Landing, CA and they were very respectful of the whales. I couldn't find a section of rules on their website but they basically followed a protocol similar to the one on the website of Newport Landing Whale Watching:
The only addition to this was that Sanctuary Cruises was very conscious to never cut in front of or across the direction of travel of a whale or group of whales. They would also cut their engines and just float when we were surrounded by whales and that was a little unnerving when we were sitting in a boat that was maybe 45' long with 50' Gray whales launching out of the water all around us.Quote:

It's OK for the whales to approach you. The distance requirements are when a whale is sighted the boat must not approach the whale closer than maybe 100 meters (I forget exactly). There's no question this guy was specifically rowing toward the whales, but I don't know if the rules only apply to power boats.
Rules apply to all boats, divers, swimmers, etc. You can not harass the whales by approaching them.
